Consumer Health Data Privacy Policy

This notice is part of the Ascend Privacy Policy (Section 14). It applies to consumer health data as defined by Washington’s My Health My Data Act and similar state laws.

This is Ascend’s Consumer Health Data Privacy Policy under Washington’s My Health My Data Act and similar state laws, such as Nevada’s consumer health data law.

Consumer health data we collect: body details and goals (age, sex, height, weight, body-fat estimate, body measurements, fitness goal); fitness activity (workouts, sets, and any discomfort you report); nutrition (food logs, diet type, food allergies and intolerances); sleep and recovery entries; data you choose to share from Apple Health or WHOOP; progress photos; and, only if you make one, the selfie for your goal picture and the goal picture itself. A face image can count as biometric data under these laws, even though Ascend never measures your face or makes a face template.

Why we collect it: only to provide the features you use, described in Section 3 of the Privacy Policy: your plans, tracking, progress, the coach, and your goal picture. We never use it for advertising, and we never sell it.

Where it comes from: you, in the App; Apple Health or WHOOP, if you connect them; and figures the App works out from your entries, such as calorie targets and scores.

Who receives it: Supabase (hosting and private storage); Anthropic, only with your AI permission (Privacy Policy Section 4A); OpenAI, only for a goal picture you ask for and agree to (Privacy Policy Section 4B); and Apple Health, only for the data types you allow Ascend to write. Ascend has no affiliates that receive it.

Your rights: you can ask us to confirm whether we collect or share your consumer health data, to give you a copy of it, to list every third party it was shared with (with their contact details), and to delete it. You can withdraw your consent at any time in Profile → AI & Your Data, by deleting your goal picture, or by deleting your account. Email support@ascendfitness.ai from the email address on your account; we respond within 45 days. If we decline your request, you can appeal by replying with "Appeal" in the subject line; we answer an appeal within 45 days, and if you disagree with the result you can contact the Washington State Attorney General (www.atg.wa.gov) or your own state’s attorney general.
