1. Acceptance of Terms
By downloading, accessing, or using the Ascend mobile application (“Ascend”, “the App”, “we”, “us”), operated by Yaseen Attrah (“the Operator”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. Continued use of the App after changes to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
Ascend is a fitness and nutrition application that uses artificial intelligence to generate personalized workout plans, weekly meal plans, calorie and macronutrient tracking, photo-based meal analysis, progress tracking, and AI coaching conversations. Plans and recommendations are generated algorithmically based on the information you provide during onboarding and your ongoing activity in the App.
3. Medical Disclaimer
ASCEND IS NOT A MEDICAL SERVICE AND DOES NOT PROVIDE MEDICAL ADVICE. All workout plans, meal plans, calorie targets, and coaching content are provided for general informational and fitness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician or qualified health provider before beginning any exercise or nutrition program, especially if you are pregnant, nursing, have a pre-existing medical condition (including but not limited to heart conditions, diabetes, eating disorders, or musculoskeletal injuries), or take medication. Stop exercising immediately and seek medical attention if you experience pain, dizziness, or shortness of breath. Never disregard professional medical advice because of something you read in the App.
4. Eligibility
You must be at least 16 years old to use Ascend. By using the App you represent that you meet this age requirement and have the legal capacity to enter into these Terms. The App is not directed at children under 13, and we do not knowingly collect information from children under 13.
5. Subscriptions, Free Trial & Billing
Ascend offers auto-renewing subscriptions purchased through your Apple App Store account (or Google Play account on Android):
- All Access — $5.29/week, $19.99/month, or $143.99/year
- Fitness Coach — $2.99/week, $10.99/month, or $71.99/year
- AI Calorie Tracker — $2.49/week, $8.99/month, or $58.99/year
- Meal Planner — $1.99/week, $6.99/month, or $45.99/year
New subscribers receive a 7-day free trial. Your payment method on file with Apple or Google is charged automatically when the trial ends unless you cancel at least 24 hours before the end of the trial period. Subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the current period ends. Manage or cancel your subscription anytime in your device Settings → Apple ID → Subscriptions (iOS) or Google Play → Subscriptions (Android). Deleting the App does not cancel your subscription. Billing, refunds, and payment disputes are handled by Apple or Google under their respective terms; we do not process payments directly. Prices may change with notice; changes apply at the next renewal.
6. Your Content
You retain ownership of the content you submit to Ascend, including progress photos, meal photos, and logged data (“User Content”). By submitting User Content you grant the Operator a limited, non-exclusive license to store, process, and display that content back to you for the purpose of operating the App (for example, storing progress photos in your private gallery and sending meal photos to our AI provider for analysis). We do not sell your User Content or use it in marketing without your explicit permission. Progress photos are private to your account. You are responsible for the content you upload and must not upload content that is unlawful or infringes the rights of others.
7. AI-Generated Content Disclaimer
Workout plans, meal plans, coaching responses, and nutritional analyses in Ascend are generated by artificial intelligence. AI-generated content can contain errors, omissions, or recommendations that are not suitable for your individual circumstances. Calorie and macronutrient estimates produced by photo scanning are approximations and can vary meaningfully from actual values depending on portion size, preparation, and ingredients that are not visible in a photo. Verify nutritional information independently where accuracy matters to you (for example, for medical dietary requirements or allergies). You use AI-generated recommendations at your own discretion and risk.
8. Prohibited Uses
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to our systems, other users’ accounts, or data; (c) reverse engineer, decompile, or extract the source code of the App except where permitted by law; (d) use automated scripts, bots, or scrapers against the App or its APIs; (e) abuse, overload, or circumvent usage limits of AI features; (f) resell, sublicense, or commercially exploit the App or its content; (g) upload malicious code or content; or (h) impersonate another person or misrepresent your affiliation.
9. Account Termination
You may stop using Ascend and delete your account at any time from the Profile tab or by contacting us at support@ascendfitness.ai. We may suspend or terminate your account if you materially breach these Terms, abuse the service, or where required by law, with notice where practicable. Upon termination your right to use the App ceases; certain provisions (including disclaimers, limitations of liability, and dispute terms) survive termination. Subscription refunds after termination are governed by Apple/Google policies.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ANY OFFICERS, EMPLOYEES, OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING INJURIES SUSTAINED WHILE FOLLOWING WORKOUT OR NUTRITION RECOMMENDATIONS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
11. Changes to These Terms
We may update these Terms from time to time. For material changes we will provide notice through the App (such as an in-app notice or update prompt) before the changes take effect. The “Last updated” date at the top of this document reflects the latest revision. Your continued use of the App after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Any disputes shall be brought in the state or federal courts located in California, unless applicable consumer law grants you rights to bring claims where you reside.
